These Terms of Sale and Service ("Terms") govern your purchase and use of Evergreen (the "App") sold via https://perfectparadox.co.uk. By purchasing a licence or using the App, you agree to these Terms, our End User Licence Agreement ("EULA"), and our Privacy Policy. If you do not agree, do not purchase or use the App.
Use of the App itself is governed primarily by the EULA; these Terms cover the commercial relationship — purchase, billing, refunds, support, and updates.
Evergreen is a native macOS application that runs entirely on your Mac. It requires macOS 14 (Sonoma) or later.
All purchases are processed by Paddle (Paddle.com Market Ltd, UK, or its affiliate Paddle Payments Ltd, depending on your region). Paddle is the Merchant of Record: it is the authorised reseller of the App, the seller named on your invoice, and the party that charges your payment method.
This means:
(a) Your purchase transaction is also subject to Paddle's Checkout Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms (b) Paddle calculates, collects, and remits VAT / sales tax for your jurisdiction. The price shown at checkout includes any applicable tax (or shows it separately, depending on your region). (c) Paddle issues your invoice/receipt and handles payment disputes, chargebacks, and refunds for the transaction. (d) We (Perfect Paradox Ltd) remain the developer and licensor of the App: the licence you receive, the software itself, updates, and support all come from us under the EULA and these Terms.
The App costs $19.99 USD (one-time). Prices may be displayed in your local currency at checkout via Paddle. We may change the price for future purchasers at any time; price changes never affect a licence you already bought.
After successful payment, your licence key is delivered by email to the address you provide at checkout, normally within minutes. If it does not arrive, check spam and then contact info@perfectparadox.co.uk — we can always recover your key from your order email address.
You can evaluate the App free for 14 days before buying. The trial is fully functional so you know exactly what you're paying for. After the trial ends, continued use requires a licence.
If you are not happy with the App, you may request a full refund within 14 days of purchase — no justification required. Because Paddle is the Merchant of Record, refunds are issued by Paddle:
(a) The fastest route: reply to your Paddle receipt email or use the link in it, or contact Paddle directly at https://paddle.net (b) Or email us at info@perfectparadox.co.uk and we will instruct Paddle to refund you.
Refunds are returned to the original payment method. Once refunded, your licence key is deactivated.
Refunds after 14 days are at our discretion, but if the App genuinely doesn't work on your supported system and we can't fix it, we will refund you — we don't want your money for software you can't use.
If you are a consumer in the UK or EU, you have statutory rights regarding digital content (including under the Consumer Rights Act 2015) that these Terms do not limit. Note that the free trial exists precisely so you can test the App before committing.
We and Paddle reserve the right to refuse refunds in cases of demonstrable abuse (e.g., repeated buy-refund cycles, refund requests after key sharing).
We provide support by email at info@perfectparadox.co.uk. We are a small independent company, and we aim to respond within 2 business days (usually much faster). Support covers installation, activation, licence recovery, and bugs in the App. It does not cover general macOS troubleshooting, custom feature development, or third-party software.
There is no phone support and no guaranteed SLA — in exchange, you get answers from the people who actually built the App.
Bug fixes and minor feature updates for your purchased major version are free and delivered via the in-app updater or https://perfectparadox.co.uk. Updates are optional and never installed without your action.
New major versions may be released as optional paid upgrades, typically with a discount for existing customers. Your current version keeps working under your existing licence regardless of whether you upgrade.
We intend to actively maintain the App, but a one-time purchase does not constitute a promise of perpetual development, specific future features, or compatibility with future macOS versions beyond those supported at the time of your purchase. If we discontinue the App, previously delivered downloads and your licence remain valid, and we will use reasonable efforts to keep licence reactivation working or provide an offline activation path.
You agree not to use the App or https://perfectparadox.co.uk to violate any law, infringe third-party rights, or attempt to compromise our systems, the licensing service, or Paddle's checkout. Licence key sharing or resale is a breach of the EULA and these Terms.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENCE, AND WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded under the laws of Northern Ireland or the United Kingdom — and nothing in these Terms affects your statutory consumer rights.
We may suspend or terminate your licence if you materially breach these Terms or the EULA (e.g., key distribution, cracking, fraud) and fail to remedy the breach within fourteen (14) days of notice. Your data is unaffected by termination — it lives on your Mac, not with us.
(a) Entire Agreement. These Terms, the EULA, the Privacy Policy, and (for the purchase transaction) Paddle's Checkout Buyer Terms constitute the entire agreement regarding the App. (b) Changes. We may update these Terms; material changes will be posted at https://perfectparadox.co.uk at least thirty (30) days before taking effect and apply to purchases made after the effective date. (c) Severability. If any provision is held invalid, the rest remains in effect. (d) Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of the business. (e) Force Majeure. Neither party is liable for failures caused by events beyond reasonable control.
These Terms are governed by the laws of Northern Ireland and, where applicable, the United Kingdom. The courts of Northern Ireland have exclusive jurisdiction, except that consumers retain any right to bring proceedings in their country of residence and any mandatory statutory protections of that country. Payment disputes relating to the checkout transaction may also be governed by Paddle's Buyer Terms.
